
The Ministry of Agriculture wants to change the regulation on the detailed conditions for recognizing land as eligible hectares. How will farmers benefit from this amendment?
2023 was the first year of implementation of the reformed Common Agricultural Policy, the Strategic Plan for the Common Agricultural Policy for 2023-2027 and the statutory and regulatory provisions.
The practice of applying one of them, specifically the Regulation of the Minister of Agriculture and Rural Development of March 10, 2023 on detailed conditions for recognizing land as eligible hectares, has shown some interpretation doubts, which is why the Ministry of Agriculture proposed in the amendment to clarify that only land covered by agri-environment-climate commitments that is also agricultural land is considered eligible areas to which direct payments may be granted.
Simultaneously it was decided to adapt the provisions of the regulation in question to the new EU regulations that entered into force on May 25, 2024 – specifically, the issue of non-productive areas, including fallow areas, and their new definitions in the amended regulations, so that farmers can receive the subsidies due.
– The recommended solution is to change, with effect from the 2024 campaign, rules setting out detailed conditions for the recognition of land as eligible hectares for which direct payments and the complementary basic payment under transitional national support are granted. The expected effect is to enable farmers to benefit from EU and national funds by defining the conditions for recognizing land as eligible hectares – we read in the justification of the proposed amendment.
